LANDSCAPE MAINTENANCE CONTRACT

Palm Beach-Beach Broward Landscaping (Contractor) agrees to provide landscape maintenance services for Royal Landings Homeowner’s Association (Client) of Boynton Beach, Florida.

Contractor carries General liability Insurance in the amount of One Million Dollars per incident. Contractor carries full insurance coverage on all vehicles and equipment. Contractor’s employees are fully covered by workman’s compensation laws required by the State of Florida. Contractor will include proof of insurance in this contract-naming client as additionally insured.

Contractor will provide all the materials, equipment, and labor needed to provide the services delineated in this contract. Contractor will hold client harmless for the results of 
its duties.

This contract begins on January 1, 2016 and continues through December 31, 2019

IRRIGATION RATES

  1. Any damage caused by vandalism or mechanical wear or failure will be billed at $55.00 an hour for a specialist and if needed $45.00 an hour per technician plus parts. Minor repairs such as replacing nozzles during the monthly quality check is billed as parts only.
  2. Any damage found during the monthly quality check that pertains to B will be repaired automatically if the cost is less then $300.00. Any Damage found that exceeds $300.00 will be estimated and require authorization from the client.

OTHER SERVICES

Any other services not stated in this contract can be done by contractor at an additional charge to be negotiated with client before service is performed.

PAYMENT TERMS

Client is invoiced on the tenth of each month; payment is due within thirty days of invoice. Client is invoiced for irrigation repairs at the end of the month. Any outstanding invoice will be subject to a 1.5% per month (18% per annum) interest rate.

 

LIASON

Client agrees that one designated Board Member and/or Property Manager will be contractor’s liaison with the community. Comments from residents will be made to the designated liaison that will relay them to the contractor.

 

EMERGENCIES

Contractor agrees to respond to emergencies within twenty-four hours, and non-emergency situations within forty-eight hours. Contractor will respond with either written or verbal acknowledgment of the situation or complaint specifying its plan of action. Any verbal complaints or emergencies must be followed up in writing by the client.

 

WEATHER

Any services delineated in this contract that cannot be performed on schedule do to bad weather such as rain or any acts of God; will be made up at a later date agreed to with the client during this contract period. Any storm cleanup following tornados, hurricanes or severe thunderstorms will be done as soon as possible at an additional charge to be negotiated between the contractor and client.

 

PROFESSIONAL DEMEANOR

Contractor agrees all employees shall each wear identifying shirts while on the property of the community. A foreman will be on the job supervising contractor’s employees at all times. All machinery, vehicles and work tools of the contractor will be safely and properly used and/or stored while on the property of the community. All debris will be removed at the end of each day before the contractor departs from the property. Client will receive a schedule at the beginning of the month stating the date’s contractor will be working on the property. Contractor will schedule bi-annual walkthroughs with the client for property inspections.

 

UNAUTHORIZED LANDSCAPING

Contractor will not maintain or be responsible for any landscape installation done by homeowners, or any landscaping that does not have board approval. Any landscaping done by homeowners must be discussed and given board approval for contractor to begin maintenance during this contract obligation.

 

TERMINATION

This contract can only be terminated by either party upon thirty day written notice to the other. In the event of termination of this contract, contractor shall not be entitled to payment for any services that were not performed, nor for any services that were scheduled to have been performed more than thirty days after the written notice of termination. Client cannot withhold payment during this thirty day Termination Period for any monies due for normally scheduled maintenance performance, nor for authorized work order services which were performed prior to the date of the written Termination Notice. Contractor may not withhold or suspend services during this thirty-day Termination Period, EXCEPT if the client refuses to pay for services performed in accordance to this contract prior to the date of the Termination Notice, contractor may suspend services immediately. All monies due to the contractor for services performed in accordance with this contract during the thirty-day Termination
Period shall be due in full to the contractor within thirty days of the final Termination Date. Changes or amendments to any section of this contract shall be in writing only, dated and signed by both parties. The voiding of any portion of this contract will not change or void any other portion of this contract. If legal dispute or legal action arise out of any portion of this contract, such legal dispute or legal action shall be in a Palm Beach County venue, with the prevailing party entitled to recover its attorney fees and legal costs.

ACCEPTANCE

We have read all the above terms of this contract and we concur with them. Contractor is hereby authorized to perform the work delineated above at the prices stated above.

EXHIBIT “A”

             In order to keep our costs down with all of our fixed expenses continually rising and not having go to our customers for additional funds, we are informing all our Association Clients that their homeowner’s must take some responsibility and make the necessary modifications that will result in avoidable damage to their property.

Palm Beach Broward Landscaping will not be responsible for the following:
1.         Any screens ripped or damaged that do not have a kick plate at the bottom or at least a 1 foot buffer bed in front of said screen to protect it.
2.         Any damages or injuries occurred by rocks flying into windows, cars, people etc. unless the rocks in the bed have a properly installed border/barrier enclosing said bed to            keep rocks inside. This is a safety issue for both the homeowners as well as for our employees.
3.         Any damages to water hoses that are not properly stored and secured.
4.         Any cut wires or damage to outdoor lighting unless they are properly installed and            buried within a planting bed. This includes proper installation of a wire guard.
5.         Any damage to statues, pots, etc, unless they are properly placed within a planting bed with approval from the Association.
6.         Underground Utilities which are not install to county code.

Palm Beach Broward Landscaping will complete a property inspection within 30 days of contract inception. Palm Beach Broward Landscaping will then provide a list to the Client of the units which are in violation of number 2 as stated above on that day of inspection.

Palm Beach Broward Landscaping will still continue to accept responsibility for any damage to property when avoidable damage occurs and any other damage will be negotiated in good faith.

 

PALM BEACH BROWARD LANDSCAPING
HURRICANE PRICE LIST 2016

 

Palm Beach Broward Landscaping has agreed to swap services while under a hurricane watch/warning and after the hurricane passes.

Hours put in over a regular work day will be billed at $35.00 an hour per person and $50.00 per hour for driver.

Tree staking will be performed at $175.00 an hour for a bobcat and a 3 man crew.

 2x4 Tree stakes will be $7.25 each (usually two to three per tree)

Black Wellington tape will be charged at $16.00 per roll (estimated to do ten trees.)
